KYP EDUCATION SDN BHD ANTI-CORRUPTION POLICY

KYP EDUCATION SDN BHD GROUP [which consists of KYP Education Sdn. Bhd. and the institutions under it, namely the UCYP University (UCYP) and Kolej Yayasan Pahang (KYP)] are committed to implementing a code of ethics on the prohibition of corruption to all employees and organizational activities and its relationship with stakeholders to ensure that all opportunities to corruption, malpractice and abuse of power can be managed and dealt efficiently and effectively. KKESB targets zero tolerance for all forms of corruption, whether directly or indirectly, and is committed to act fairly, professionally and with integrity in providing services. To realize the target, KKESB emphasizes the following four (4) terms of references:

A. POLICIES, LEGISLATION AND REGULATIONS

  1. Understand and comply with related anti-bribery laws, regulations and other instructions.

  2. Implement anti-bribery elements in policy formulation to increase internal control over governance weaknesses and breaches of integrity.

B. SYSTEMS AND WORKING PROCEDURE

Identify, study the weaknesses and improve from time to time the systems and working procedures that give the opportunities for bribery behavior, abuse of power and malpractice.

C. STRENGTHENING GOVERNANCE, INTERGRITY AND ACCOUNTABILITY

Sowing, educating and cultivating integrity and accountability as well as strengthening governance in service delivery. This healthy work culture allows all parties to be accountable not only within the scope of their respective departments, but also cross sectional in nature.

D. DETECTION, COMPLIANCE, PUNITIVE AND RECOVERY

  1. Empower and disseminate reporting mechanisms on corruption, abuse of power and malpractice.

  2. Ensure compliance with regulations, take punitive action against violations of the code of conduct and carry out remedial efforts.

The Board of Directors and Top Management of KKESB are committed to implementing and enforcing effective policies and procedures throughout KKESB for the prevention, monitoring and elimination of any form of bribery and corrupt practice amongst all employees and within its activities, which include relationship with stakeholders; towards the delivery of efficient services with integrity, in line with KKESB Vision and Mission, and national aspirations as follows:

  1. Comply with and adhere to the provisions of the Malaysian Anti-Corruption Commission Act 2009 (Act 694) and other applicable laws, regulations, rules, policies and procedures to which they are bound to observe in the performance of their duties.

  2. The Governing Body and KKESB’s Top Management are committed to implementing control and continuous improvement through KKESB’s Anti-Bribery Management System (MS ISO37001: 2016).

  3. Provide channels and encourage the reporting on alleged corrupt activities through the KKESB Whistleblowing Policy.

  4. Not to give, promise to give, offer, solicit for or accept any gift contrary to the KKESB Granting and Accepting Gift Policy.

  5. Integrity Officer is responsible for monitoring compliance with the Anti-Bribery Management System and reporting to Governing Body and KKESB Top Management.

  6. Each employee has a duty to read and understand the Policy. Non-compliance with and violation of the Policy by employees may result in disciplinary action by KKESB in accordance with its policies, procedures, directives and guidelines and / or initiation of legal proceedings against those involved.

This policy applies to all KKESB staff. This policy should also be used as a guide by stakeholders, business associates or any individual / organization dealing with KKESB citizens / facilities and must be complied with. Violations of this policy allow for legal and / or disciplinary action to be taken against those involved.

PERNYATAAN POLISI

Polisi ini menggariskan panduan bagi melaporkan sebarang bentuk penipuan, penyalahgunaan dan penyelewengan serta salah laku dalam kalangan warga kerja Kumpulan KYP Education Sdn. Bhd. (KKESB). Dalam masa yang sama, ia melindungi identiti Pemberi Maklumat (Whistleblower).

APA YANG BOLEH DIDEDAHKAN?

  1. Rasuah atau penipuan

  1. Kesalahan jenayah

  1. Salah guna wang atau harta KKESB

  1. Kesilapan pengurusan yang melampau dalam KKESB

  1. Ketirisan kewangan yang serius dalam KKESB

  1. Gangguan seksual

  1. Kesalahan tatatertib lain

  1. Perkhidmatan KKESB

IDENTITI PENGADU DILINDUNGI

Mana-mana individu yang mahu melaporkan salah laku briberi / rasuah dan pelanggaran integriti akan dilindungi oleh Polisi Perlindungan Pemberi Maklumat.

Di bawah Polisi Perlindungan Pemberi Maklumat ini, laporan boleh dibuat terhadap mana-mana individu yang mempunyai kaitan dengan KKESB dan Anak Syarikat, sekiranya disyaki melakukan salah laku briberi / rasuah dan pelanggaran integriti. Sebarang kes salah laku atau pelanggaran integriti yang dilaporkan akan disiasat menurut prosedur dan undang-undang yang berkaitan.

MAKLUMAT YANG DIPERLUKAN

Untuk membolehkan siasatan dilakukan dengan cekap dan berkesan, maklumat yang disertakan adalah:

  1. Nama pengadu, nombor telefon, alamat surat-menyurat dan e-mel

  2. Nama, nombor telefon dan alamat surat-menyurat mana-mana pihak yang disebut di dalam aduan

  3. Butiran khusus mengenai bagaimana, mengapa dan bila perkara yang diadukan itu berlaku

  4. Bukti atau maklumat saksi yang boleh membantu siasatan

Kriteria utama pelaporan adalah maklumat yang benar berasaskan bukti dan tidak melibatkan kepentingan peribadi mana-mana pihak.

** Walaubagaimanapun, jika aduan yang diterima tidak menepati kriteria yang telah ditetapkan di atas, aduan tersebut akan turut dipertimbangkan untuk tujuan siasatan.
